Scope of Agreement

These Terms of Use ("Terms") apply to each ISTH Website, which include, but are not limited to www.isth.org, www.isthacademy.org, www.isth2013.com, www.ssc2012.org, www.journalth.com, the various websites of ISTH past, present and future Congresses, Meetings, and subcommittees, and any other Internet site on which these Terms are posted.

These Terms constitute the entire agreement between you and ISTH and any and all entities that control, or are controlled by, or are affiliated or under common control with, ISTH (collectively referred to throughout these Terms as "we," "us" or "our") and constitute the entire agreement relating to our Online Services, superseding all prior or contemporaneous statements, whether electronic, oral or written.

Note that special terms may apply to some of the services offered on ISTH websites. Any special terms will be posted in connection with the applicable service and are in addition to these Terms. In the event of a conflict between these Terms and any special terms, the special terms will prevail over these Terms.

You acknowledge that these Terms are supported by reasonable and valuable consideration (such as your use of our website or receipt of information and materials available at or through an ISTH website), the receipt and adequacy of which are hereby acknowledged.

Password and Security

Portions of ISTH’s websites are secure and may require you to register in order to participate in those areas. User accounts issued for ISTH’s websites are for individual use only and you are solely responsible for maintaining the confidentiality of your user name and password. You agree to provide accurate and complete information about yourself when registering or otherwise providing information regarding your account and to update your account data to keep it accurate and complete and to log out when you conclude each session. You agree that we may store and use the information you provide for maintaining your account. You also agree not to misrepresent your identity or affiliation with any person or entity, including (but not limited to) using another person's username, password or other account information. Violations of our security systems may result in civil or criminal liability. You agree to notify us immediately of any unauthorized use of your password or account or any other breach of security. We will take every effort to ensure your online security, but cannot and will not be liable for any loss or damage arising from your failure to comply with these provisions.

By accessing or using this website, or using any services or software that access or use this website, you consent to the terms of these Terms of Use, including our Privacy Policy, as they most recently have been amended. The Privacy Policy and the rest of these Terms of Use may be changed from time to time, and so you should ensure you are familiar with the current version.

User Conduct

Our websites are intended for the benefit of our members and other users to promote the exchange of information, education and learning in the field. You agree to use this website only for such purposes. You may not use this website for any other purpose, including any business or commercial purpose, without ISTH's express prior written consent. Any unauthorized commercial use of this or any ISTH website, server or related services, or the resale of related services, is expressly prohibited.

As a condition of your use of these services, you expressly agree that you will not use our websites, software, or other products or services for any purpose that is unlawful or prohibited by these Terms. You agree to abide by all applicable local, state, national and international laws and regulations and are solely responsible for all acts or omissions that occur when you are logged in,including the content of any information submitted or posted on this website.

Use of Content

All information, files, materials, functions and other content accessible from any ISTH website, or otherwise controlled by ISTH ("Content") is the proprietary material of ISTH or the party that provided or licensed the Content to ISTH. The delivery of Content does not transfer to you any proprietary rights in the Content. Any downloading or printing capabilities are solely an accommodation to you and shall not constitute a grant, waiver, or other limitation of any rights of the copyright owners in any Content. You may not modify, copy, distribute, display, send, perform, reproduce, publish, license, create derivative works from, transfer, or sell any information, content, software, products or services obtained from, or otherwise connected to, any ISTH website.

Any Content on any ISTH website that is configured for downloading, such as learning modules, other workshop downloads, and any other resources, may be downloaded for your personal, noncommercial use only, provided that you do not: (a) remove, alter or modify any copyright, trademark, trade name, service mark or other proprietary notices; (b) modify the Content; or (c) use the Content in a way that suggests an association with the ISTH other than the required attributions of source.

Any software downloads, including any files or images incorporated in or generated by the software, that are offered on a ISTH website are licensed to you for your personal use only. The owner of all licensed software, whether a third party or ISTH, retains all rights, title and interest in the software and you may not yourself or assist someone else to copy, distribute or otherwise exploit the software or decompile, reverse engineer or otherwise attempt to discover any of the source code. You acknowledge that certain Content may include security technology that limits your use of such Content and that, whether or not Content is limited by security technology, you shall use Content in compliance with the applicable usage rules established by ISTH and its licensors, and that any other use of the Content may constitute a copyright infringement.

You are responsible to protect any Content that you download and ISTH will not be responsible for Content that is lost, destroyed or damaged for any reason. ISTH reserves the right to change any Content, as well as eligibility for access to any particular Content, without notice. You acknowledge that, if we make such a change, you may not be able to use Content to the same extent as prior to such change and that ISTH shall have no liability to you in such case. Discontinued or currently unavailable merchandise also may be removed from our website. If you are unable to locate a product, a service or the information that you recall from a previous visit, please send us an email and we will make every effort to assist you.

ISTH cannot and does not guarantee the contents or security of electronic files located on our sites. Accordingly, we cannot assure that users will not be exposed to inappropriate material. Further, all users must recognize that scientific knowledge perpetually expands and changes. ISTH does not guarantee the accuracy of any information posted on its websites; and no professional or patient should rely on information provided on our websites as a substitute for the appropriate application of medical judgment based on individual patient examination and the appropriate standards of patient care. ISTH does not make individualized treatment recommendations or provide advice that is warranted to be accurate or applicable to any particular individual patient.

Your Submissions to Our Websites

We may expressly request or enable you to submit, post, upload, embed, display, communicate or otherwise distribute messages, ideas, concepts, drawings, photographs, graphics, videos, or other material or information through a ISTH website ("Submissions"). Please do not make any Submissions to or through our websites that we do not expressly request or enable you to submit. Our policies regarding Submissions apply regardless of whether we request any Submission received on or through our websites.

Some of our websites may contain communications services provided through forums, bulletin board services, chat areas, message boards, news groups, communities, personal web pages, calendars, and/or other message or communication features designed to allow you to communicate with others. You agree to use such communication services only to make and receive Submissions that are related to the particular communication service and in accord with these Terms.

You agree that you will not post, send, publish, or transmit any Submission that:

  • Violates any copyright, patent, trademark, trade secret, intellectual property or other proprietary or contractual right; or
  • Advertises any commercial or business endeavor (for example, offering products or services) or otherwise engages in any commercial activity (for example, conducting raffles or contests, displaying sponsorship banners, and/or soliciting goods or services) except as may be specifically authorized by us;
  • Harms or can reasonably be expected to harm any person or entity, including but not limited to material that is a violation of privacy, defamatory, abusive, harassing, threatening, or exploits or harms children by exposing them to inappropriate content; or
  • Is illegal or encourages, advocates or discusses illegal activity; or
  • Openly seeks, or passively collects, personal or personally identifiable information about or from others; or
  • Includes programs that contain viruses, worms and/or Trojan horses or any other computer code, files or programs designed to interrupt, destroy or limit the use or enjoyment of any our websites; or
  • Otherwise violates any provision of these Terms.

ISTH does not endorse any Submission and expressly disclaims any and all liability in connection with any Submission. ISTH may refuse or remove any Submission that, in its sole judgment, violates these Terms. You are solely responsible for any Submission you submit to any of our websites.

You should be aware that in some instances, your Submissions are public, not private communications. When you are using the areas of our websites that publicly display Submissions, you should assume that any Submissions you make to these areas also are subject to being made public. You should never post any message that you would not mind seeing on a school or community bulletin board or in the local newspaper. The privacy of others also should be respected at all times. If you need permission to use any photos, writings or other material or any identifying information contained in a Submission, you are responsible for obtaining documentation of such permission before posting the Submission. We may prohibit or remove certain Submissions that have been posted in public areas of our websites, in accord with our policies, but we are under no general duty to monitor the public posting of Submissions in such areas. When you voluntarily disclose any personal information (which is further defined in our Privacy Policy) through any Submission in a public area, that information can be viewed, collected and used by others and may result in unsolicited messages from other people, for which we shall have no responsibility.

By providing Submissions to any of our web sites, you hereby grant ISTH the royalty-free, perpetual, irrevocable, worldwide, non-exclusive right and license to reproduce, use, copy, sell, distribute, create derivative works from, perform, and display all or part of the Submission in any form, media, or technology now known or later developed. Except in the case of certain Submissions by students or teachers participating in any form of online instruction, ISTH will not be required to treat any Submission as confidential. However, we may use any Submission in our business endeavors (including without limitation, for products or advertising) in a manner consistent with our privacy policies, without incurring any liability for royalties or any other consideration of any kind, and will not incur any liability as a result of any similarities that may appear in our future operations.

By providing Submissions to a ISTH website, you also represent and warrant that the Submission is your original work, does not violate any agreement between you and a third party, and shall not infringe upon or violate any law, agreement or other rights of any kind, of any third party, without limitation, rights affecting copyright, patent, trademark, unfair competition, contract, defamation, privacy or publicity.

Access to and use of secure areas of ISTH sites is considered a privilege provided at the discretion of ISTH. ISTH reserves the right to monitor use of its websites to determine compliance with these Terms, to investigate any reported or apparent violation, and to take any action that we in our sole discretion deem appropriate. We also reserve the right to immediately withdraw access and use of our sites when there is reason to believe that violations of law or our policies have occurred. We also reserve the right at all times to disclose any information as necessary to satisfy any applicable law, regulation, legal process or governmental request, and to edit, refuse to post or to remove any information or materials, in whole or in part, in our sole discretion. Submissions provided to any of our websites may be subject to posted limits on use, reproduction and/or dissemination and you are responsible for abiding by such limitations with respect to any Submissions that you provide, as well as any materials that you may download.

Termination of Service

These Terms of Use constitute an agreement that is effective until terminated by either party.

You are not required to continue use of these services. And, if you are dissatisfied with any aspect of the services, you are encouraged to contact the ISTH Headquarters to discuss your concerns.

You may ask us to close your account at any time by sending us an email. We reserve the right to terminate this agreement, as well as your access to any or all of our websites and the related services or any portion thereof, at any time, without notice.

Effect of Termination

Upon termination of this Agreement, you will no longer access or use any part of this website or use any service or software to access or use this website. Your representations, warranties, and agreements with respect to your past access and use will continue in effect (for example, the licenses granted to ISTH for content that you uploaded; and your indemnification against infringement with respect to such materials) but you will incur no new obligations because there will be no future use.

Disclaimer and Limitation of Liability

You agree that use of any part of any of our websites or online services is entirely at your own risk. The content on our websites is provided in good faith, "as is," and without warranties of any kind, either express or implied. To the fullest extent permissible by law, ISTH disclaims all warranties, expressed or implied, including, but not limited to, implied warranties of merchantability and fitness for a particular purpose. ISTH does not warrant that any of our websites or materials on the websites will be uninterrupted or error-free, that defects will be corrected, or that any of our websites or the servers that make them available are free of viruses or other harmful components. ISTH does not warrant or make any representations regarding the use or the results of the use of the content on any of our websites. Applicable law may not allow the exclusion of implied warranties, so the above exclusion may not apply to you. You acknowledge that we may include links to other websites and that ISTH has no control over, and makes no representations of any kind regarding such websites, and you hereby irrevocably waive any claim against ISTH with respect to any linked websites.

In no event will ISTH, or any person or entity involved in the provision of these online services, be liable for any damages, including, without limitation, direct, indirect, punitive, actual, incidental, consequential, special, exemplary, or other damages, arising as a result of your use or access to any of the Content on our websites, or inability to use or access our websites, or arising out of any breach of warranty even if ISTH has been advised of the possibility of such damages. Indemnity

You agree to indemnify and hold ISTH, its subsidiaries, affiliates, licensors, content providers, service providers, employees, agents, officers, directors, representatives and contractors ("Indemnified Parties”) harmless from any breach of these Terms by you, including any Submissions or use of Content other than as expressly authorized in these Terms. You agree that the Indemnified Parties will have no liability in connection with any such breach, alleged breach or unauthorized use, and you agree to indemnify any and all resulting loss, damages, judgments, awards, costs, expenses, and attorneys' fees of the Indemnified Parties arising out of your breach, alleged breach or unauthorized use. You also agree to defend, indemnify and hold the Indemnified Parties harmless from and against any claims brought by third parties arising out of your use of any of our websites.

Trademarks and Copyrights

Any trademarks, service marks, logos, and copyrighted works appearing in this website are the intellectual property of ISTH or their owners, who retain all rights in that respect. Any unauthorized use of such intellectual property may violate copyright laws, trademark laws, the laws of privacy and publicity, as well as other communications regulations and statutes. We also respect the intellectual property rights of others and ask that anyone who uses or accesses our website do the same. ISTH reserves the right, from time to time, with or without notice to you, to make changes to these Terms in our sole discretion. Continued use of any part of this website constitutes your acceptance of such changes. No Agency

You agree that no joint venture, partnership, employment, or agency relationship exists between you and ISTH as a result of these Terms or use of any ISTH website.

No Waiver

Any failure to enforce any of the provisions of these Terms shall not be construed to be a waiver of our right to enforce such provision.

Applicable Law and Venue

ISTH maintains its headquarters in the State of North Carolina, United States of America. You agree that these Terms will be governed and interpreted by the laws of North Carolina and the United States of America. You also agree that the exclusive venue for any dispute between you and ISTH that arises out of, or relates to, these Terms is in the state or federal courts of North Carolina, and you specifically consent to the personal jurisdiction of North Carolina courts. We make no representation that the Content on any ISTH website is appropriate or available for use in any particular location. Those who choose to access our websites act on their own initiative and are responsible for compliance with all applicable local or other laws.

Cancellation/Refund Policy

All cancellation/refund requests are to be sent in writing by email to headquarters@isth.org. For membership cancellations received after January 1 of the year of the paid membership, refunds will be prorated. No refund will be made after June 30 of the paid membership year.

Severability

If any portion of these Terms of Use is unlawful, void or unenforceable, that portion will be deemed severable from these Terms and will not affect the validity and enforceability of the remainder of these Terms.

 

 

PRIVACY POLICY

The International Society on Thrombosis and Haemostasis (“ISTH”) is a global not-for-profit membership organization advancing the understanding, prevention, diagnosis and treatment of thrombotic and bleeding disorders. We do not knowingly attempt to solicit or receive information from children.  We understand that you are aware of and care about your personal privacy interests; we take those interests seriously.

This Privacy Policy describes the ISTH’s policies and practices regarding its collection, use, and protection of your personal data, and sets forth your privacy rights.  Information privacy is an ongoing responsibility and we will from time to time update this Privacy Policy as we revise our personal data practices or adopt new privacy policies.

How ISTH collects and uses/processes your Personal Information

You can utilize some of ISTH’s services without giving ISTH your personal data. Much of the information on our Website is available to those who are not ISTH members. You can enter only the minimum amount of information (name and contact information) to your ISTH profile and you can edit your profile at any time. For ISTH members additional information is required (details below in the Membership section). Some personal information is necessary so that the ISTH can supply you with the services you have purchased or requested, and to authenticate you so that we know it is you and not someone else. You may manage your ISTH subscriptions and you may opt-out of receiving certain communications at any time.

ISTH may ask for a password, secret answers to certain security questions or other information that will allow us to identify a guest's account or provide a guest with access to their account or certain Online Services. Because many of our products and services are designed for educational use, some of the personal or contact information that we request may be about institutions and schools instead of, or in addition to, information about the guests themselves. We also collect various demographic information, such as whether our guests are medical practitioners and, if so, whether they see patients; the research and medical specialties and subspecialties of our guests; and other demographic information. When we use or associate other information with information that could be used to identify or contact a guest specifically, this other information is considered personal information for purposes of this Privacy Policy.

In order to ensure that users are provided with accurate information about their accounts, and content geared to the interest of that user, we may ask for personal information when a user registers for, logs on to, or visits our websites or other Online Services, or participates in activities on our websites.

We may request a user's personal information when they:

  • Log on to one of our websites or Online Services
  • Place an order on one of our websites for products or services (such as, but not limited to registration for events);
  • Register or create an account on any of our websites;
  • Send us an email or otherwise contact us using the online tools that we have provided on any of our websites, including for example "Contact Us” features;
  • Submit customer ratings or reviews, testimonials, product ideas or ideas for the classroom or other education experience;
  • Sign up for one of our newsletters, or request information, marketing materials or other communications;
  • Participate in any social or community areas, including for example blogs and forums; and/or
  • Enter any of our contests or promotions.

As noted above, our websites and Online Services also collect some usage information automatically. Please see below for more information.

We sometimes supplement the information that we collect as outlined in this Privacy Policy with information that we receive from other sources and entities. Such outside information includes, but is not limited to, updated delivery, billing, and address information, and information about products and services utilized, from carrier services or other third parties such as publishers, congress organizers, and others who offer products or services to us and our users.

 

1. Membership

When you become an ISTH member, we collect information about you including (but not limited to) your name, email, mailing address, phone number, designation, place of work, year of birth, primary professional focus, prescriptions, primary basic research area, and primary medical specialty area. For associate members, we also require proof of status from an individual’s university. Members may edit their profile at any time to change, add, or make private personal information.

We process your personal information for membership services, to deliver member benefits to you, and to inform you of ISTH-related events, content, and other benefits or opportunities associated with your ISTH membership. ISTH may also use this information to help the ISTH understand its members’ needs and interests to provide products and services to meet its members’ needs.

 

2.  Congresses, Workshops, Events, Meetings, On-line Courses, and Conferences

The ISTH sponsors events including in-person conferences like the Congresses, as well as workshops, education courses, webinars, and Scientific and Standardization Committee (SSC) meetings (collectively “events”). If you register for one of our events and you are a member, ISTH uses the information in your member account to provide you with information and services associated with the event.  If you are not a member and you register for one of our events, we will collect your name and contact information and use it to provide you with information and services associated with the event.

ISTH also collects information from presenters and lecturers at its events, including name, employer and contact information, and photograph.  ISTH may also collect voluntarily-provided evaluation information provided by event attendees. ISTH may also make and store a recording of the event in certain instances.

ISTH may keep a record of an individual’s participation in ISTH events as an attendee or presenter, which may be used to provide membership services (such as, for example, to tell you about other events and publications). It may also be used to help the ISTH understand our members’ needs and interests to better tailor our products and services to meet those needs.

In association with our Academies, you will have the option to download the ISTH Academy App.  The ISTH Academy App may require the device identifier associated with your device.  When registering or ordering on the app, the User may be asked to enter his/her name, email address, mailing address or other details to help with the experience. The app uses a random identifier, which is a session number attributed to the User as he/she enters the site. This session number is expunged in this Platform system as the User leaves.  Information is collected from the User when he/she registers on the Platform, places an order, enters information, writes posts/comments, adds content to favorites, provides ratings or submits educational content (such as documents, videos, narrations and images), are active on an educational activity, download materials, create content (such as quizzes), and when the User uses mobile devices' resources (such as camera or microphone) to scan Quick Response (QR) codes, submit photos, record narrations and send educational materials. If an event is sponsored in whole or in part by an entity other than ISTH, ISTH may provide an attendee list to sponsors, co-sponsors and exhibitors. ISTH may also allow sponsors, co-sponsors and/or exhibitors to send you material by mail/e-mail once per sponsored event, in which case the ISTH will share your mailing address directly with the sponsor/exhibitor. If you do not wish to have your information included in an attendee list or to receive information from sponsors, co-sponsors and/or exhibitors, you can express your preferences when you register for events or you may contact the ISTH directly at registration@isth.org.

 

3.  Publications

ISTH offers publications for its members and the general public. ISTH may provide a link to another organization’s website (for example, databases and registries) which may contain content that is relevant and useful. To access this content, you will leave the ISTH website, and ISTH is not responsible or liable for content provided by these third party websites or personal information they may collect from you.

You may subscribe to some of ISTH’s publications without becoming a member. For example, you may sign up to receive the ISTH’s eNewsletter by providing us with at least your first name and last name, an email address, and the country in which you live. ISTH does not share this information with any third party other than to provide you with the eNewsletters and other communications from ISTH which ISTH believes may be of interest.

You may manage your ISTH subscriptions by subscribing or unsubscribing at any time. Please note that if you have set your browser to block cookies, this may impact your ability to unsubscribe. 4.  Training

If you participate in ISTH training, you may sign up directly through ISTH and we will collect your name, contact and payment information (if there is a fee). You may, alternatively, sign up for training by or through a third party such as one of our partners. We may also use independent contractors to conduct the training and third parties to provide the training venue. Your personal information will be stored in our database (hosted by cloud service provider) and may also be shared with our training partners, instructors, and/or the venue hosting the event (to verify your identity when you arrive). ISTH’s training partners, instructors, and training venue hosts have agreed not to share your information with others and not to use your personal information other than to provide you with ISTH products and services.

 

5.  Your Communications with ISTH

While using some of our products or services, you may have the opportunity to provide photographs, videos or other materials that may contain information that would enable identification of the user. Bearing this in mind, you should review any material you provide, to ensure that it is appropriate for sharing. Similarly, some of our Online Services may offer online social, community or other communication features that allow users to post, or share with others, messages, stories, pictures, artwork, videos, testimonials, lesson plans, or other content. Along with such content, users also may be given the opportunity to post certain personal information about themselves, their school and other miscellaneous information related to the content.

Please note that although ISTH may take various steps to protect our users, we cannot guarantee that content posted by a user will not be seen by someone other than the audience intended by the user. Before you disclose to ISTH Personal Data of another person, you have to obtain that person's consent to both the disclosure and the processing of that person’s Personal Data in accordance with this Privacy Policy.

 

6.  Payment Card Information

You may choose to purchase goods or services from the ISTH using a payment card. Typically, payment card information is provided directly by you, via the ISTH website, into the PCI/DSS-compliant payment processing service to which the ISTH subscribes, and ISTH does not, itself, process or store the card information. Occasionally, individuals ask ISTH employees to, on their behalf, enter payment card information into the PCI/DSS-compliant payment processing service. ISTH strongly encourages you not to submit this information by fax. When ISTH employees receive payment card information from individuals by email, fax, phone, or mail, it is entered as instructed and then deleted or destroyed.

 

7.  Personal information we get from third parties

ISTH may receive personal information about individuals from third parties. For example, we may receive personal information from your employer if it signs you up for training or membership. One of our third-party training partners may also share your personal information with ISTH when you sign up for training through that partner.

 

8.  Your Use of the ISTH Website

ISTH’s website automatically collects certain information and stores it. The information may include internet protocol (IP) addresses, the region or general location where your computer or device is accessing the internet, browser type, user’s computer hardware and software, and operating system, the type of Online Service being used (including the product ID or serial number and product license information) and other usage information about the use of ISTH’s website, including a history of the pages you view. We use this information to help us design our Website to better suit our users’ needs.

We also may collect general information about how, and how often, users use, browse, or view content on our websites, which products they buy and how users use and interact with our Online Services. This information, as well as information regarding access times and referring website addresses helps us maintain the quality of our services and gather general statistics about our Website users. In most cases, the usage information described above does not identify users personally, but in some cases may be linked to personal information such as an email address. Depending on which of our websites or the type of Online Service being used, and the specific type of usage information being collected, some or all of such information may be linked to the user's account.

Additionally, if a user receives our emails in HTML format, we may use technological methods to improve our services and communications to the user by, for example, determining whether that user has opened or forwarded our emails and/or clicked on links in those emails or to determine whether the user has made an inquiry or purchase in response to a particular email. We may also use your IP address to help diagnose problems with our server and to administer our Website, analyze trends, track visitor movements, and gather broad demographic information that assists us in identifying visitor preferences. ISTH’s Website also uses cookies and web beacons (see below). It does not track users when they cross to third party websites, does not provide targeted advertising to them, and therefore does not respond to Do Not Track (DNT) signals.

The ISTH Website uses Google Analytics, a web analytics service provided by Google, Inc. ("Google") to track how often individuals access or read ISTH content. Google Analytics uses "cookies", which are text files placed on your computer, to help the website analyze how users use the site. The information generated by the cookie about your use of the website (including your IP address) will be transmitted to and stored by Google on servers in the United States.  We use this information in the aggregate to understand what content our members find useful or interesting, so we can produce the most valuable content to meet your needs.  Google will use this information for the purposes of evaluating your use of the website, compiling reports on website activity for website operators and providing other services relating to website activity and internet usage. The ISTH uses a marketing database management program that deploys a cookie when a user interacts with a marketing communication, such as a marketing email or a marketing-based landing page on our website. This cookie collects personal information such as your name, which pages you visit on the ISTH website, your history arriving at the ISTH website, your purchases from the ISTH and the like. We use this information to evaluate the effectiveness of our marketing campaigns. You may set your browser to block these cookies.

ISTH tracks users when they cross from our primary public website (ISTH.org) to our ISTH membership portion of the Website by logging in with their user name and password, as well as when visitors to our website enter through a marketing landing page. 9.  Use and Processing of Personal Data

ISTH processes your personal data to provide you with the goods or services you have requested or purchased from us, including membership services, events, training, workshops, publications and other content.  We use this information to refine our goods and services to better tailor them to your needs and to communicate with you about other services ISTH offers that may be relevant to you.

Personal Data submitted to ISTH by you will be used for the purposes specified in this Privacy Policy or on the relevant pages of the ISTH Website or collection point. ISTH may use your Personal Data to:

  2. personalize the Website for you;
  3. verify your identity when placing an order, logging into an account, or to prevent unauthorized access to or use of a user’s account information;

Information about your ISTH purchases and membership are maintained in association with your membership or profile account. The personal information ISTH collects from you is stored in one or more databases hosted by third parties located in the United States. These third parties do not use or have access to your personal information for any purpose other than database storage and retrieval. ISTH may also engage third parties to send information to you, including items like publications you may have purchased, or material from an event sponsor.

ISTH does not otherwise disclose or otherwise transfer your personal data to third-parties for their independent use unless: (1) you consent or authorize it; (2) it is necessary for the performance of the contract you have signed with us; (3) it is in connection with ISTH-hosted and ISTH co-sponsored conferences as described above; (4) the information is provided to comply with the law (for example, to comply with a search warrant, subpoena or court order, or for tax obligations), enforce an agreement we have with you, or to protect our rights, property or safety, or the rights, property or safety of our employees or others; (5) the information is provided to our agents, vendors or service providers who perform functions on our behalf; (6) to address emergencies or acts of God; or (6) to address disputes, claims, or to persons demonstrating legal authority to act on your behalf; and (7) through the ISTH Member Directory. We may also gather aggregated data about our members and Website visitors and disclose the results of such aggregated (but not personally identifiable) information to our partners, service providers, advertisers and/or other third parties for marketing or promotional purposes.

Please note that when we disclose or transfer your personal data to third-parties to provide limited services on our behalf, such as publishing and/or sending newsletters, operating our meetings, fulfilling and shipping orders that users have placed and completing transactions requested by users, we provide those companies with the information that they need to provide us with the specific task they have been hired to do, and we prohibit them from using that information for any other purpose, and we require them to abide by strict information privacy standards.

The ISTH Website may interface with social media sites such as Facebook, LinkedIn, Twitter, Instagram and others. If you choose to "like" or share information from the ISTH Website through these services, you should review the privacy policy of that service. If you are a member of a social media site, the interfaces may allow the social media site to connect your site visit to your personal data.

If you participate in Congresses, training, meetings or other events, ISTH may use and publish your Personal Data, photos and video impressions taken during the events and/or meetings for ISTH´s purposes.

ISTH will not, without your express consent, supply your Personal Data to any third party for marketing purposes, whether directly or indirectly.

The ISTH makes member information available through the ISTH Member Directory to other ISTH members using the Website. Members may choose whether to keep their personal data private by logging into their account and changing their preferences.

 

11. Personal Data Transfer to the United States

ISTH has its headquarters in the United States. Information we collect from you will be processed in the United States. The United States has not sought nor received a finding of “adequacy” from the European Union under Article 45 of the GDPR.  ISTH relies on derogations for specific situations as set forth in Article 49 of the General Data Protection Regulation (“GDPR”). In particular, ISTH collects and transfers to the U.S. personal data only: with your consent; to perform a contract with you; or to fulfill a compelling legitimate interest of ISTH in a manner that does not outweigh your rights and freedoms. ISTH endeavors to apply suitable safeguards to protect the privacy and security of your personal data and to use it only consistent with your relationship with ISTH and the practices described in this Privacy Policy. ISTH also minimizes the risk to your rights and freedoms by not collecting or storing sensitive personal information about you.

 

12.  Data Retention

Your personal data is stored on the servers of the cloud-based database management services the ISTH engages. ISTH retains data for the duration of the customer’s or member’s business relationship with ISTH.  ISTH may retain all information you submit for backups, archiving, prevention of fraud and abuse, analytics, satisfaction of legal obligations, or where ISTH otherwise reasonably believes it has a legitimate reason to do so.  In some cases ISTH may choose to retain certain information in a depersonalized or aggregated form.  For more information on where and how long your personal data is stored, and for more information on your rights of erasure and portability, please contact the ISTH at headquarters@isth.org.

 

13.  Your Choices and Rights

Where processing is based on consent, you shall have the right to withdraw your consent at any time.  The withdrawal of consent shall not affect the lawfulness of processing based on consent before its withdrawal.

If you no longer wish to receive communications from us, you can let us know by sending us an email at headquarters@isth.org.  The communications we send you may contain opt-out mechanisms that allow you to change your preferences.  All users registered with one of our websites can log into their account and access or update the contact information currently associated with that account, including for example a mailing address or email address. Users also may be able to use our websites to view and update information regarding recent orders, payment settings (such as credit card information), email notification settings and prior order history. If a password has been forgotten, a user also can find instructions for resetting it on the account information page.

With respect to communications preferences, a user can unsubscribe from newsletters by following the instructions included in any newsletter received. A user whose email address has changed and would like to continue to receive newsletters, will need to access the account and update the email address information and might need to sign-up again for the newsletter. Occasionally, we will send out emails concerning website disruptions, new products and other news about our products and services. These emails are sent to all account holders and are not subscription-based. Such emails are considered a part of our service to the users of our websites. A user can opt-out of these communications by following the opt-out instructions at the end of the email.

Subject to local law (for example, the European Union’s General Data Protection Regulation provides certain rights for data subjects), you may have certain rights regarding information that we have collected and that is related to you. We encourage you to contact us to update or correct your information if it changes or if you believe that any information that we have collected about you is inaccurate. You can also ask us to see what personal information we hold about you, to erase your personal information and you may tell us if you object to our use of your personal information. In some jurisdictions, you may have a right to complain to your local data protection authority. You may also request information about: the purpose of the processing; the categories of personal data concerned; who else outside ISTH might have received the data from ISTH; what the source of the information was (if you didn’t provide it directly to ISTH); and how long it will be stored. You have a right to correct/rectify the record of your personal data maintained by ISTH if it is inaccurate. You may request that ISTH erase that data or cease processing it, subject to certain exceptions. You may also request that ISTH cease using your data for direct marketing purposes. In some countries, you have a right to lodge a complaint with the appropriate data protection authority if you have concerns about how ISTH processes your personal data. If required by law, ISTH will, at your request, provide your personal data to you or transmit it directly to another controller.

Reasonable access to your personal data will be provided at no cost to ISTH members, conference attendees and others upon request made to ISTH at headquarters@isth.org. If access cannot be provided within a reasonable time frame, ISTH will provide you with a date when the information will be provided. If for some reason access is denied, ISTH will provide an explanation as to why access has been denied.

 

14.  Security of your Information

ISTH maintains physical, technical and administrative safeguards to help protect the privacy of data and personally identifiable information transmitted to ISTH.  ISTH updates and test its security technology on a periodic basis. We restrict access to your personal data to those employees who need to know that information to provide benefits or services to you.  We train our employees about the importance of confidentiality and maintaining the privacy and security of your information. We commit to taking appropriate disciplinary measures to enforce our employees' privacy responsibilities.

Any user who chooses to register with any ISTH website or on Online Service will be required to create a password. This password can be changed by the user at any time by first logging into the service by using the current password and then setting a new one. It is the user’s responsibility to keep the password confidential. A user who has logged in from a computer that is shared with others should always log out of the website before leaving it to prevent subsequent users of that computer from accessing information under their log in. A user who believes that someone has used their password or account without their permission, or has a reason to believe there might have been a breach of security, should notify us immediately to reset their password.
